Indian Patent Statistics

A total of 1029 patent applications have been published in the 9th issue of the Patent Journal, 2019. Out of the 1029 applications, 126 applications account for early publications while 903 applications account for ordinary publications or publications occurring after the 18-month period. A total of 447 applications were granted last week marking an increase of about 10.91% in grants.

 Invention 1: I-SPRAY: INTELLIGENT THIEF IDENTIFIER THROUGH UV-GAL SPRAY

Abstract: The Invention is needed in Indian society because of the India is very highly influence in this of any house; object etc so we provide the strongest this identification solution. The invention is given a unique Ultra Violet Gel to provide and identity the thief who is associated with the theft This invention will have a sensor which is attached to the lock and will give signals to the control unit in case of opening it forcefully or with a master key or if the thief tries to break in forcefully or any another way. The invented system received the signal, after receiving the signal from the sensor; the control unit will activate the nozzle through which the Ultra Violet Gel is sprayed to the thief. If a thief gets a spray of the unique UV Gel, the spray will last on his skin for a time period of about 20-month to 34-month. If a theft has happened and the Gel is sprayed to the thief, the invention will generate a unique identity code for the spray which will be used to identify the thief. The unique code is given to the police department so that when the thief is caught, they can identify the thief by putting him under UV light.  Invention 2: ENVIRONMENTAL MONITORING DRONE: FLYING NOSE

Abstract:A drone for monitoring environmental parameter and pollutant parameter to analyze the environment. It is built with pollutant measuring sensors mounted on robotic arm under drone, which records the parameters with location and time. It is also having a camera for capturing the current scenario of forest, city or unreachable area while recording parameters. Flying Nose drone records real-time data like SPM, UV intensity, Co gas, Co2 gas, Nox gases, Sox gases Temperature, Humidity, Pressure, Altitude, Location, Time and Picture. Because of these data, Flying Nose is very useful for rendering model of any place and analyzing the environment of specific places. The Flying Nose drone flies near to land. Therefore, Flying Nose drone receives accurate and high-resolution data than satellite. Flying drone data gets plot on map with color code for easiness in analyzing. The Flying Nose drone is having capability to capture sample of air for further laboratory analysis of air. The sensor mounted robotic arm under drone can extend outside the vortex of propeller for accurate readings. Latest Draft Manual of Patent Office Practice and Procedure published by IPO

The latest Draft Manual of Patent Office Practice and Procedure, 2019 was published by the Office of the Controller General of Patents, Designs & Trade Marks. Stakeholders may send in their suggestions on or before 21st March 2019. All suggestions may be sent via email to “wm.dhumane@nic.in”. The suggestions received will be considered and the final version of the Manual will be published on 01-04-2019.

National IP Awards 2019 – Date extended

The last date to send in the applications for the 2019 national IP awards has now been extended to the 15th of March 2019. More details on the awards may be found here.

National Policy on Software Products – 2019, receives sanction from the Union Cabinet

The Union Cabinet led by Prime Minister, Shri Narendra Modi has sanctioned the National Policy on Software Products, 2019 (NPSP) last week. The NPSP 2019 foresees the establishment of an ecosystem that harbors software products in India. The Policy will stay on par with other initiatives by the government including Digital India, Startup India, Skill India and Make in India – to promote a healthy industry and create employment opportunities. It will have a major impact on innovation by fostering the creation of IP assets thereby boosting development and revenue. Key interests of the Policy, include –

  • To promote the creation of a sustainable Indian software product industry
  • To nurture tech – startups
  • To create a talent pool for upskilling IT Professionals and students in schools and colleges
  • To build a cluster based innovation driven ecosystem

The policy further provides for the establishment of the National Software Products Mission which will aid in implementing and assessing these objectives.

NI – MSME to organize a 5 – day training session on Intellectual Property Rights

The National Institute for Micro Small Medium Enterprises has organized an exclusive training session for MSME’s, academic and research institutions, enterprises, IP professionals, technology transfer cells and for anybody involved in innovation. The sessions will begin from 11th March, 2019 at the NI – MSME headquarters in Hyderabad. The 5 – day session aims to foster IP awareness, create interest and discuss upcoming issues in the field on Intellectual Property. The training sessions will include all fields of IP i.e., Trademarks, Industrial Designs, GI’s, Copyrights and Patents. MSME’s will also be made aware of the various schemes and incentives available to them. Attendees will be able to take away knowledge on IP management, commercialization and enforcement.

RGNIIPM Nagpur to launch an IP Innovation Gallery

The Rajiv Gandhi National Institute of Intellectual Property Management (RGNIIPM), an Institute of the Central Government established under the supervision of the Ministry of Commerce & Industry, will launch an IP Gallery to showcase the countries best innovation models and other information related to intellectual property. The Innovation Gallery will be launched on 8th March, 2019 at RGNIIPM, Nagpur. The Gallery intends to exhibit ideas and motivate inventors. In order for the inventors to have their inventions on display, they will have to meet the eligibility criteria, however no fees will be charged for the demonstration. RGNIIPM will continue to accept proposals for the Gallery until 7th march, 2019. For more information, click here.

Patent / Design Infringements, Disputes, Licensing and Settlement

Huawei and Samsung end patent infringement dispute

The two – year battle between Huawei Technologies and Samsung Electronics came to an end on 26th February after the companies filed a motion in the United States Court of Appeals for the Federal Circuit. The tech giants filed a joint motion to stay all further proceedings for a period of 30 days, under the Federal Rule of Appellate Procedure 27. The parties have reportedly reached a settlement on 25th February, 2019; the intention of the stay is to work out the details of the settlement. Even though the terms of the settlement are unknown, the Appellant, Huawei is expected to file a motion to dismiss the Appeal. Click here to access the joint motion.

Blackberry and Twitter in a tussle

On 27th February, 2019 Blackberry filed a suit on Twitter for infringement of its patent under 35 U.S.C §1 et seq. The suit, filed in the United States District Court for the Central District of California involves 6 patents, namely – U.S Patent No. 8,676,929; 8,296,351; 9,349,120; 9,021,059; 8,286,089 and 8,572,182. Blackberry is now seeking an injunction and has demanded that the Defendant recalls and destroys all of the infringing products and materials. It also seeks the award of damages, Attorney fees and other expenses incurred in the filing of the suit. The official document can be accessed here.

Blackberry had previously filed a similar suit against Facebook, last year, after which Facebook filed a counter suit.
