DPIIT floats draft guidelines for implementation of IPR policy in academic institutions
The Department for Promotion of Industry and Internal Trade (DPIIT) has published a 23-page ‘Draft model guidelines on implementation of IPR policy for Academic Institutions’ prepared by the Cell for IPR Promotion & Management (CIPAM). The draft proposes guidelines in respect of Ownership of IP, Commercialisation and Benefit Sharing, Licensing Agreements and Revenue sharing, Limitation of Liability, Sharing of Costs with regard to IP protection, Waiver of IP rights by the Academic Institutions and Promotion of the use of Free and Open Source Software (FOSS) among several other points. As per the draft the right in a patent will rest with the academic institution if a student, researcher or faculty member has used its resources and funds for developing a product. However, if an institution determines that an invention was made by an individual on his or her own time and unrelated to his or her responsibilities towards the institution and was conceived without use of its resources, then the invention shall vest with the individual or inventor. Capcom wins patent infringement lawsuit in Japan
Famous gaming major Capcom has won the verdict of the Japanese Intellectual Property High Court, against Koei Tecmo, a Japanese video game holding company, in a patent infringement suit spanning 5 years. Japan’s Intellectual Property High Court ruled in favor of Capcom and directed Koei Tecmo to pay $1.3 million in damages to Capcom. The infringement suits revolves around two patents held by Capcom i) a patent on using controller vibration to alert players to the presence of an off-screen enemy and ii) a patent on certain methods for “unlocking bonus content when the DVD-ROM of the latest title of a game series is set in a game console, by placing the DVD-ROM of the previous title of the game series into the console.”
Bridgestone claims victory in China in patent infringement case
Well known tire manufacturer Bridgestone Corp., has claimed victory against Chinese tire makers Shengtai Group Co. Ltd. and Shandong Shengshi Tailai Rubber Technology Co. Ltd in a design infringement suit involving Bridgestone’s Blizzak VRX studless winter tire. According to tirebusiness.com Bridgestone said Shengtai was ordered in July to cease activities, dispose of the dedicated molds and pay Bridgestone damages in the amount of approximately $125,000.

Heads of UKIPO, EPO and USPTO discuss global patent system
Heads of the UKIPO, EPO and USPTO – Tim Moss, President António Campinos and Andrei Iancu, met at an patent showcase event held on the 13th of September in London. The heads discussed their visions for the future of the global patent system, the transformation taking place within IP offices, and the cooperation between them. They also shared thoughts on how these developments will benefit users of the global patent system.
While, President Campinos provided an update on the EPO’s recently published Strategic Plan 2023, its five strategic goals and how it will ultimately form a new framework for cooperation among all stakeholders in the IP system; Director Iancu spoke about the USPTO’s work on Artificial Intelligence and how they are approaching the issues it presents for them. UKIPO head Tim Moss also spoke about the importance of the collective influence of big IP offices and how they drive reforms, ensure digitised and customer-led services and the wider importance of having a general understanding of IP.
