Patent Licensing, Commercialization and Acquisitions

Broadcom considering acquisition of Qualcomm

Singapore-based semi conductor giant Broadcom is reportedly considering acquiring Qualcomm, the world’s third-largest chipmaker and mobile chip maker. The deal if sealed, is ,likely to have an impact on Korean semiconductor and mobile phone companies such as Samsung Electronics, and LG Electronics. Broadcom is the world’s fourth-largest semiconductor company and Wi-Fi chip maker, and already has a huge patent portfolio. An acquisition of Qulacomm would however bolster Broadcom’s patent portfolio to mammoth proportions.

Patent disputes, infringement and settlements

US ITC launches probes against Samsung

The United States International Trade Commission has launched a probe against Samsung after US semiconductor packaging firm Tessera Advanced Technologies accused Samsung of violating patents regarding wafer level packaging – a technology that simplifies the packaging of wafers and reduces the volume of finished products.

Tessera has asked the ITC to ban the sales of Samsung chips and smartphones, tablet PCs and laptops that use the chips.

BananaIP’s Patent Tip of the Week

Prosecution History Estoppel

Patent prosecution is an iterative process and it is during this process that the applicant often changes the language of their proposed claims. The doctrine of prosecution history estoppel, formerly known as file wrapper estoppel has been defined as an equitable tool for determining the scope of patent claims. Prosecution history estoppel therefore dictates that claims must be interpreted in the light of their rejections, cancellations and amendments.
