This week 5390 applications have been granted registration, marking an increase of fifty-three percent (53%) in comparison to the week prior.

The mark has been filed by LBJ Trademarks LLC, under Class 25 pertaining to clothing and apparels, and Class 41 for educational service. The mark has been filed with the USPTO with the serial number 87630975.

Verizon Trademark Services LLC (Plaintiff) vs. Mr Parth Solanki & Anr (Defendants)
Subject – Trade Mark Infringement, Passing Off, Dilution
Brief Facts – The Plaintiffs, part of the Verizon Group of Companies are the proprietors of numerous trade mark registrations consisting of the mark VERIZON. The Plaintiffs are engaged in providing communication, entertainment, information technology, website development and security products and services under the trade mark VERIZON and the logo since 2000. The plaintiffs have secured registrations in various classes including class 42 with respect to web-hosting and web-development related services. The Plaintiffs learned that the Defendants have been using a descriptively similar mark ‘VARIZON’ and using the domain name www.varizontech.com. The suit was filed before the Delhi High Court seeking relief for trade mark infringement against the Defendant’s use of a similar mark and domain name.
Judgment: The Court held that without any explicit permission or authorization, the Defendants’ malafide use of the Plaintiffs trade mark VERIZON amounts to infringement and is bound to cause incalculable losses, harm and injury to the Plaintiffs. The Court, therefore, issued a decree of permanent injunction restraining the Defendants from using the mark ‘VARIZON’ or any other mark similar to that of the Plaintiffs’ registered mark.

Apple Files for ProMotion
Apple Inc., the American multinational tech major has filed a new trade mark application for the mark ‘ProMotion’. The mark has been filed on 17th November, 2017 with the EUIPO bearing Application Number 017491986. The application has been filed under class 09 with the description ‘Computer graphics software; computers; computer display screens; handheld mobile digital electronic devices used as a telephone, personal digital assistant, electronic personal organizer, and electronic notepad computer, and used to access the internet, electronic mail, digital audio and video, and other digital data; computer display screen software’. The mark has been filed in order to protect its new ‘promotion technology’ which offers better user interface.

Anushka Sharma, the Indian actress has launched a new clothing line under the name ‘NUSH’. The fashion label has been launched in partnership with Suditi Industries. The brand is available offline at Shoppers Stop, and online through Myntra. The brand focuses on western wear keeping today’s youth in mind.

West Bengal won the Geographical Indication (GI) battle over Rasogolla
The 26 month long battle between West Bengal and Odisha over the much loved sweet Rasogolla has come to an end with the GI Registry granting registration to West Bengal for ‘Banglar Rasogolla’. The application was filed by the West Bengal State Food Processing and Horticulture Development Corporation Limited on September 18th, 2015 bearing GI no. 533.
