Indian Patent Statistics

A total of 681 patent applications have been published in the 7th issue of the Patent Journal, 2019. Out of the 681 applications, 56 applications account for early publications while 625 applications account for ordinary publications or publications occurring after the 18-month period. A total of 389 applications were granted last week marking an increase of about 9.27% in grants.

Invention 1 – PROCESS OF MAKING ENERGY RETAINING GARMENTS AND CLOTHES WITHOUT CONVERTING CERAMICS

Abstract:  “A process of making an energy retaining garments and clothes is provided. The energy retaining garment (104) includes an energy retaining composition and a reiki healing pattern (202). The energy retaining composition includes one or more phyllosilicates (e.g., kaolinite, montmorillonite), one or more cyclosilicates (e.g., schorl tourmaline, dravite tourmaline or elbaite tourmaline), one or more metal oxides (e.g., an aluminum oxide, and a zinc oxide, a titanium dioxide, a zirconium oxide) and one or more tectosilicates (e.g., a quartz and a granite). The materials present in the energy retaining composition include energy reflecting and energy generating characteristics. The energy retaining composition is applied to a garment as a coating finish. The energy retaining composition is not breathable. The energy retaining composition applied to the reiki healing pattern (202) to obtain a patterned energy retaining garment (104). Invention 2 – METHOD AND SYSTEM FOR REMOVAL OF RAIN STREAK DISTORTION FROM A VIDEO

Patent Application No.: 201741028472

Applicant: WIPRO LIMITED

Abstract:  “Systems and methods for removing rain streak distortion from a distorted video are described. The system receives sample nondistorted images and sample distorted images of a video. The sample non-distorted images are indicative of non-raining condition and the sample distorted images are indicative of raining condition in the video. The system further determines first temporal information from the sample distorted images and second temporal information from the sample non-distorted images. The first temporal information indicative of a change in the rain streak distortion pattern and the second temporal information indicative of a change in a non-rain streak distortion pattern. Further, the system correlates the first temporal information with the second temporal information to generate a training model comprising one or more trained weights. Further, the system removes the rain streak distortion from a realtime distorted video by applying the training model, which results in the generation of the non-distorted video.”(The abstract has been provided as is and has not been corrected for errors)

Indian Patent Updates

IPA seeks removal of India from US Priority Watch List 

The Indian Pharmaceutical Alliance (IPA), the lobby group for the domestic pharma industry, has filed a submission to the US Trade Representative (USTR) to remove India from its Priority Watch List (PWL), which includes countries that are alleged to have weak enforcement of patent laws. In April 2018, the USTR published its Special 301 Report which placed 36 countries including India on the Priority Watch List.

Qualcomm faces fines to the tune of $242 million in Korea

The Supreme Court of Korea in a judgment passed last week has upheld the Korean FTC’s (Fair Trade Commission) initial fine of $242 million on Qualcomm. The Supreme Court found that most of the FTC decisions in 2009 to impose a total of 273 billion won (US$242 million) worth of fines on Qualcomm for illegal kickbacks from 2000 to 2009 were lawful. However, of the 273 billion-won penalty, the court ruled the chipmaker should pay at least 200 billion won, while the remainder needs be reconsidered at a lower court.

International Patent Updates

GIPC publishes the 7th International IP Index – “Inspiring Tomorrow”

The U.S Chamber of Commerce Global Innovation Policy Center (GIPC) published the 7th edition of the International IP Index called “Inspiring Tomorrow” on 7th February, 2019. The Index consists of a thorough analysis of IP regimes of the top 50 economies in the world. The Index is formed on the basis of 40 parameters which include activities such as commercialization of IP Assets, enforcement of laws, trade secrets, systemic efficiency etc. According to the analysis, U.S.A and U.K have maintained their positions as the top economies while Singapore and Japan have reached the top 10. India on the other hand has moved from the 44th position in 2018 to the 36th position, this year. Patrick Kilbride, Senior Vice President of GIPC said “India’s performance on the Index finely captures the government of India’s incremental, consistent initiatives over time to improve the country’s IP ecosystem, guided by the vision of the 2016 National IP Policy.” The complete report can be accessed here.
