Indian Patent Statistics

A total of 1261 patent applications have been published in the 28th issue of the Patent Journal, 2019. Out of the 1261 applications published in the journal, 75 applications account for early publications while 1186 applications account for ordinary publications or publications occurring after the 18 – month period. A total of 294 applications have been granted last week as compared to 726 grants in the week preceding the last thereby marking a decrease of about 59.5%

IDENTIFY POLLUTANTS FROM VEHICLE EXHAUST AT TOLL PLAZAS WITH PROVISION OF PENALTY

Abstract –“A method and a system for checking pollution level of a vehicle on a freeway is provided. The method includes the steps of: detecting presence of the vehicle approximate to a pollution checking area disposed near to a toll collection centre; instructing to a controller of the vehicle to reduce speed of the vehicle approximate to zero when the vehicle enters the pollution checking area; initiating a timer indicating a start time to initiate a pollution test for the vehicle; activating a plurality of pollution checking sensors within the pollution checking area to monitor presence of pollutants therein; estimating release of pollutants from an exhaust port of the vehicle using outputs of respective plurality of pollution checking sensors, wherein the plurality of pollution checking sensors avoid physical contact with the exhaust port of the vehicle; communicating the estimated release of pollutants of the vehicle to at least one computing device configured for a law enforcement agency along with registration details of the vehicle and ownership details of vehicle; and receiving at least one instruction from the at least one computing device to impose penalty on driver of the vehicle when the estimated release of the pollutants is beyond a threshold release of the pollutants.”(This abstract has been provided as is and has not been corrected for errors.)

DRINKABLE SEA WATER: DESIGN INTELLIGENT SOLAR ADSORPTION DESALINATION & COOLING SYSTEM ON SEA WATER

Abstract –“The Invention DRINKABLE SEA WATER is to Applicable See water. The technology – Desalination is one of the most traditional processes to generate potable water. With the rise in demand for potable water and scarcity of fresh water resources, this process has gained special importance. Conventional desalination system use coal as a fuel for water heating purpose. Although coal is depleting with time and it is harmful to human. In addition, conventional thermal desalination processes involve evaporative methods such as multi-stage flash and solar distils, which are found to be energy intensive, whereas reverse osmosis based systems have high operating and maintenance costs. My invention is describes the Try bed Adsorption Desalination (3-BAD) system, which is an emerging process of thermal desalination cum refrigeration capable of utilizing low-grade heat easily obtainable from even non-concentrating type solar collectors. The system employs a combination of flash evaporation and thermal compression to generate cooling and desalinated water. Parabolic trough collector used for heating of water. To design, construct and test the solar desalination system with try and more adsorbed bed. It also has the ability to cool the water along with potable water. The cycle produces 7.598 litres/day in a span of 7.30 hours with a COP of 0.697, which is maximum, comes at noon. DPIIT receives reduced budgetary allocation for Financial Year 2019-20

On 5th July 2019, the Finance Minister of India, Nirmala Sitharaman slashed tradition and presented the Union Budget wrapped in a red cloth emblemizing the national emblem of the country. According to Budget 2019, the Department for Promotion of Industry and Industrial Trade (DPIIT) has been awarded a reduced budget for the fiscal year 2019-20. DPIIT’s budgetary allocation has been reduced to 5,674.51 crores from the previously allocated 6140.23 crores in 2018-19. On speculation, it has been observed that the reduction in the revised budget is due to the rising demands from segments relating to the development of the national industrial corridors and the Startup India initiative. Additionally, Intellectual Property segments received an increase of about 41% in fiscal allowance. For the year 2018-19, rupees 212 crores were allotted to this segment, whereas this year, 300 crores have been awarded. The Make in India initiative, launched in 2014 in order to create a global hub for manufacturing also observed a dramatic increase from 149 crores to 473 crores, this year.

RMNLU, Lucknow invites applications for Post-Graduate Diploma in IPR

Dr. Ram Manohar Lohiya National Law University, situated in Lucknow, is currently inviting applicants for admission into the Post-Graduate Diploma Program in Intellectual Property Law, for the year 2019-20. Interested applicants holding a graduate degree in any discipline from a University recognized by the UGC with at least 45%, will be eligible to apply for the program. Patent backlog down by 50%

Commerce and Industry Minister Piyush Goyal informed the parliament on Friday that around 1.04 lakh patent applications in India were pending for examination at the end of June this year, compared to around 2.04 lakh at the end of the 2016-17 financial year. The commendable decrease of backlog by 50% has been attributed primarily to the increase in number of examiners at the patent office.  In the written reply to the Rajya Sabha, the Minister has stated that As many as 15,284 patents were granted in 2018-19, while 1,12,856 applications are pending in the various patent offices at Chennai, Mumbai, Kolkata and Delhi.

TiVo & LG sign expanded IP Licensing Agreement 

TiVo Corporation recently announced that it has expanded its global intellectual property (IP) license agreement with LG Electronics (LG). According to Nasdaq the deal expands LG’s previous deal for Rovi patent portfolio license to presently cover the TiVo patent portfolio. The new agreement is expected to enhance the ability of LG’s customers to “discover and enjoy entertainment content on multiple devices.”

Brazil cotton farmers sue Bayer

Brazilian cotton producers have reportedly sued Bayer AG seeking to cancel the chemical company’s patent protection for its Bollgard II RR Flex genetically modified cotton seed. The farmers, hoping to regain $151 million in royalty payments, claim the genetically modified seed does not constitute a de facto technological innovation. The lawsuit also names Brazil’s national patents office as a defendant

ASHA organizes People’s Conference to mobilize farmer’s rights in India

The Alliance for Sustainable & Holistic Agriculture (ASHA), recently held the People’s Conference in order to collectively fight for the rights of farmer’s in India and prevent a relapse of the ‘Gujarat Potato farmer’s’ episode. To ensure the safety of the farmer’s seed rights under the Protection of Plant Varieties and Farmer’s Rights Act, 2001, a number of legal and IPR experts graced the occasion and discussed matters of critical importance. Experts at the event particularly reexamined the PepsiCo India v. Farmers case and formulated a plant of action to prevent the repeat of similar incidents. In addition to IPR and legal experts, a number of farmer’s rights activists attended the event. Dr. R.C Agrawal, Registrar General of PPV & FR Act, 2001 explained the key aspects of the referenced act and discussed the means to implement the same. A spokesperson at the Conference said “A provision should be included in the Act and its Rules that no legal proceedings can be initiated against farmers in India without authorization by the PPV&FR Authority. Suo moto powers to be vested with the Authority to support farmers, under Section 8 of the Act, to provide various kinds of support to farmers anywhere in the country, if any registered breeder is claiming exclusive rights.”
