Indian Patent Statistics

A total of 1304 patent applications have been published in the 8th issue of the Patent Journal, 2019. Out of the 1304 applications, 107 applications account for early publications while 1197 applications account for ordinary publications or publications occurring after the 18-month period. A total of 403 applications were granted last week marking an increase of about 3.59% in grants.

 Invention 1 – BLUETOOTH ENABLED, LIVE STREAMING MICRO SPY ROBOT

Abstract:   As the world is progressing towards the technical and automation advancements, deficiency of interest is seen in human effort and manual methods. This paper presents a DPIITDPIITDPIIT Bluetooth enabled, Live Streaming Micro Spy Robot DPIITDPIIT• which uses the battery as the power source and capable of surveillance the area of operation by its high definition rotating camera DPIITDPIITs. This project aims at developing a highly automation robot along with the multi functioning purpose. There is an increasing need to create artificial arms for different inhuman situations where human interaction is difficult or impossible. Here we propose a programing based robot in which a multilevel mechanism is inbuilt. The robot is able to function in both day and night circumstances. This is specially a defense based programming robot which is used for surveillance, capturing high definition images, location tracker, bomb diffusing ability, wire cutting ability, thermal sensing capacity. It is programming and sensor based robot so that it is easier to control. It is a technical automation based robot that runs on the automatic controls. It is incorporate with the sensors. The perfect utilization of this robot is the place of impossible terrains and unreachable footstep by human. Where there the human efforts gets fail then we use this kind of technology. There is a bomb diffuser mechanism installed in this robot so that this save the human life risk from the threat. An Arduino, Bluetooth module, GPS module, motor driver IC, cutting blade, thermal sensors, toxic gas sensors are the main components of this robot.  Invention 2 –: FRAW – FROTHY DRINK STRAW

Applicant: RISHI KESAV MOHAN

Abstract:The product invented is a variant of conventional straw with a perforation/slit along with a limiting ring. The limiting ring controls the level of frothiness. It is aimed at enhancing the aroma/flavor of packaged drinks; providing consumers a sense of larger volume of the drink and lightening thick beverages and beverages for prolonged experience. It works by mixing air with the beverage/drink and making it frothy. This gives the consumer better taste and increase sales of the beverage/drink. Indian Patent Updates

National Conference on “IPR for Global Business: Forward Looking Agenda for India”, held in Bangalore

IIM Bangalore hosted the National Conference on IPR for Global Business on the 22nd of February, 2019. The Conference was held in collaboration with the Federation of Indian Chambers of Commerce and Industry (FICCI), Visvesvaraya Trade Promotion Centre (VTPC) along with IIM Bangalore. The opening address was delivered by the Director of IIM Bangalore, Prof. G. Raghuram. The keynote speakers included Shekar Viswanathan – Vice Chairman and Director of Toyota Kirloskar Motors; OP Gupta – Controller General of Patents Designs & Trade Marks, Rear Admiral Atul Khanna, Additional Director of the Ministry of Defense and several other eminent people. The discussion in the Conference ranged from upcoming challenges in IP, National IP Policy, enhancing transfer of technology and bringing about policy changes in order tackle issues and to bring India’s IP regime on par with that of the world among others.

First Patent Facilitation Centre in Ranchi

Jharkhand will soon have the state’s first ever Patent Facilitation and Information Centre. The Jharkhand Council on Science and Technology (JCT), under the guidance of the Department of Higher and Technical Education is all set to establish the Facilitation Centre at the Ranchi Science Centre in Chiroundi. In furtherance to the establishment of the same, JCT has released the expression of interest (EoI) and is currently anticipating the receipt of proposals. The Centre will increase IP awareness in the state, equip future inventors to make informed decisions, specifically relating to patent matters. Technical Officer, Raghuvansh Mani also explained that initiatives are being taken to enhance collaboration between other IP cells in the country in order to exploit the advantages of the new establishment.

Patent / Design Infringements, Disputes, Licensing and Settlement

 Kibow Biotech Inc. wins patent suit in India

La Renon, a pharmaceutical company based in India, filed a law suit against Kibow Biotech challenging the validity of its Patent Application No. 351/MUMNP/2006, in the year 2013. The Intellectual Property Appellate Board dismissed the suit and believed the patent in question to be valid. The Patent – 224100 titled “Composition for Augmenting Kidney Function” is primarily related to a series of Probiotics and Prebiotics namely Renadyl for human consumption and a variation of the same for animals called Azodyl. Filing of an Appeal in the High Court of Madras lead to further examination of the matter. On 22nd February, the High Court upheld the decision of the Intellectual Property Apellate Board (IPAB), leading Kibow to victory. Currently, the company owns patents for the same invention in a number of countries including Japan, China, Korea, USA, EU and many more.

International Patent Updates

EPO and others hold discussion over patentability of plants

Following a decision in the case T 1063/18 by the Board of Appeal of The European Patent Office; the EPO, the Committee on Patent Law and all of the 38 Contracting States of EPO gathered under one roof to discuss the required future actions on plant patentability. The European Commission acted as the Observer during the talks. The parties have jointly agreed to take the opinion of the Enlarged Board of Appeals, in this matter. More discussions have been said to take place over the following days to come. The objective of the discussions is to mainly find a solution for the general public and provide “legal certainty.”

The case T 1063/18, primarily involves a conflict between the interpretation of Article 53(b) EPC and Rule 28(2) EPC, by the Enlarged Board of Appeal in its previous decisions namely – G 2/12 and G 2/13. Click here to access the full judgement passed in T 1063/18.

Webinar on Technology Transfer to be held by EPO

The European IPR Helpdesk has scheduled a Webinar on the topic of Technology Transfer on the 13th of March, 2019. The Webinar is free and is open to anybody having basic knowledge related to the matters of IPR. The same will be presided by Dr. Christian Hackl from TUM Tech GmbH, Germany. The webinar will span over a period of 60 minutes and an extra 15 minutes will be allotted for Q&A sessions. Topics including the need and importance of Technology Transfer, methods of technology screenings, risk management during and after the transfer and licensing options will be explained.
