Indian Patent Statistics

There has been a massive drop in the total number of applications published last week. A total of mere 403 patent applications have been published in the 41st issue of the patent journal. Out of the 403 applications, 42 applications account for early publications while 361 applications account for ordinary publications or publications occurring after the 18 month period. A total of 186 applications have been granted this week thereby marking a decrease of about 42.24% in total grants as compared to the preceding week.

Invention 1 – SMART THEFT PREVENTION SYSTEM USING GSM AND CLOUD

Abstract: “In recent days, the rate of theft has increased drastically to a very high alarming amount. Though there are many systems of security that exists today, most of them are outsmarted by the intruders. The CCTV cameras are capable of recording everything that happens in a place 24 x 7 and stores everything in a backup memory (hard disk). But it is unable to alert the owner at the time of intrusion. Also, the present-day CCTV system cannot prevent the theft. This proposed project is to provide a smart security system to the society by interfacing a large number of electrical and electronic gadgets. This product makes use of a motion sensor interfaced with a microcontroller chip and some additional devices to alert the owner of the Shop/ House/ Building to be secured. When the thief enters into the Shop/House/Building where the product is installed, Phone call is made to the owner whose number is initially coded in the microcontroller. Video of the intruder is taken at the time of intrusion and these videos are sent to the cloud server and it can be viewed using our own mobile App. Provisions are made to control the equipment such as Lights (ON and OFF) and Siren (ON and OFF) that are connected to the product by the Mobile App by means of cloud. When this product becomespopular and is used by many customers all these products can be connected to a web server and can be connected to the police data base. This can be monitored by the police department. Abstract:  “The World Health Organization (WHO) reported that there are 285 million visually-impaired people worldwide. Among these individuals, there are 39 million who are totally blind. The inability to identify people during group meetings,is a disadvantage for blind people in many professional and educational situations. There have been several systems designed to support visually-impaired people and to improve the quality of their lives. Unfortunately, most of these systems are limited in their capabilities. The purpose of the device to make blind interact with the society. The smart device incorporates facial recognition technology to alert the user when they are approaching a relative or friend. Patents to be granted faster says DIPP Secretary

Ramesh Abhishek, the Secretary of the Department of Industrial Policy and Promotion (DIPP) while speaking at the International Conference on IPR held by the Confederation of Indian Industry (CII) in New Delhi on the 8th and 9th of October expressed that the Indian Patent Office is taking several steps in order to aid quick patent grant. The Secretary also added that the patent office intends to bring down the examination of applications to 18 months by the end of next year or definitely by March 2020 as opposed to the current examination period of 5-7 years.

Nestlé’s Skin Health accused of patent infringement

Truinject, a Delaware-based developer of injection technologies  has filed a complaint against Nestlé’s Skin Health unit accusing the unit of infringing patents and misappropriating trade secrets relating to Botox (botulinum toxin) injections. According to the suit, Nestlé Skin Health arranged for Truinject to demonstrate its technology in 2014 and the companies allegedly signed a number of confidential disclosure agreements, which stated that Nestlé could only use Truinject’s confidential information to evaluate a potential deal with Truinject.

However, Nestlé allegedly  started to develop its own injection training technology in 2015. The Delaware company is seeking a disgorgement of Nestlé’s profits, triple damages for wilful infringement, and an order preventing further acts of infringement.

Teva and Eagle Pharma file patent infringement suit against Mylan and Fresenius

 Teva Pharmaceutical Industries and Eagle Pharmaceuticals have reportedly filed a lawsuit in Delaware aimed at stopping the market entry of a generic version of blood cancer drug called BENDEKA (bendamustine HCl) proposed by Mylan and Fresenius.  Teve and Eagle have claimed that Mylan and Fresenius’ marketing applications infringe on two new U.S. patents issued this past summer to Teva and Eagle.

Qualcomm versus Apple – setback for Qualcomm

In a first anywhere for the ongoing legal fight between Qualcomm and Apple, a Munich regional court has rendered a final judgment in a Qualcomm patent complaint against Apple, awarding victory to Apple. A three-judge panel has ruled that the iPhone 7 and 7 Plus do not violate Qualcomm’s European patent, EP1199750, which covers a “post-passivation interconnection scheme on top of an IC chip. The decision comes just one week after a trial, which may suggest that even if Qualcomm files an appeal with the Munich Higher Regional Court, it could face an uphill battle.
